Terms and Conditions

Due to the personal nature of our products we can’t offer a refund or exchange if you change your mind once the order has been processed

Gift vouchers are not refundable or redeemable for cash.

Portraits Terms of Trade

We the Customer understand that we are totally responsible for ourselves and the safety and well-being of family/children and pets during the photo session
Portrait Booking fees are non-refundable but transferrable as long as 48hrs notice is given to the studio.
Customer understand the Studio owns copyright of all images and gives their permission for the Studio to use any photograph taken by the Studio in any manner, such as for the purposes of professional photo award competitions, advertising or promotion, albums etc
Customer understand that although files are available with some packages the copyright remains with the studio, Customers do however have a licence to reproduce domestically ie for themselves. However no other party can use these images for profit/gain or non-profit eg Pet Store, Vet Clinic etc.
To avoid disruption to the photographic coverage and to allow the Studio to fulfil its contracted duty, other photography by family./friends at this time is not permitted.
Customer understand that all files are keep for a period of 28 days from the date of the photography session
All orders must be confirmed in writing and accompanied by full payment unless prior arrangement has been made with the studio
The Studio takes the utmost care with respect to all aspects of your photography requirements. However, in the event that the Studio fails to comply with the terms of this agreement, due to negligence, accident, or any other avoidable or unavoidable action, the Studios liability is limited to a refund of monies that have been paid to the Studio.
Any promotions cannot be combined, gift certificates/offers/prizes cannot be accumulated, ie one per session only.
This agreement is made in the state of New South Wales. These terms of trade shall not be varied except by agreement in writing.

We the Customer have read, understand and agree with the above conditions.

Wedding Terms of Trade

These terms of trade together with the booking form/schedule are an agreement by which we will be commissioned as the sole photographer &/or Videographer your wedding. By using the services of Diamond Portraits (hereinafter referred to as the Studio) the Customer agrees to these terms of trade.

Customer understands that the price of the photography &/or video package will not change from the time of booking, except for variations in GST, which is currently 10%. Prices of any additional options that appear on the booking form are firm at time of booking, provided these options are paid for with the balance of the package prior to the wedding. Any options that are not paid for prior to the wedding are subject to the prices at time of order. All prices published in our 1/2/2019. Any albums & options ordered after the date of booking will be charged at the current price at that date.
Customer agrees the payment of the initial deposit, either $750 for photo or video, or $5100 for combined services confirms their booking for wedding photography and Video on the date detailed above and understands that this deposit is not refundable or transferable to another date. The cancellation of the photography &/or video for the above mentioned date will mean that this deposit is forfeited. Cancellation within 3 months of the wedding date will mean that the balance of the package is also payable to the
Customer confirms that they have received a copy of the Studio wedding price list dated 1/2/2019 and they agree to make the payment required as per the price list for the package chosen by them. Packages chosen can be up scaled only. They are also aware that the balance of the photography &/or video package is required to be paid 5 weeks prior to the wedding date by personal or bank cheque, funds transfer, cash or credit card (an additional 2% bank service fee applies to credit card payments – MasterCard & visa only accepted).
Extra hours are available should the customer wish to extend their coverage, at $200 for photography or video.
For coverage’s where the photographer/videographer is required to remain after the guests are seated at the reception, please provide a meal for the photographer/videographer & arrange this with the reception venue. The Studio cannot be held responsible for anything that may be missed at the reception should the photographer be seated in an area other than the main reception room. Customer understands that should our nominated photographer/videographer not be available, the Studio will provide us with another photographer/videographer and advise us of that change.
High Resolution Images are available after the wedding, once the final album and enlargements have been completed. Copyright is available for domestic use only i.e. Customer reprints. Images are not to be used for any advertising/commercial purposes by the customer or any 3^rd party such as Reception Venues, Wedding cars etc without written approval from the studio. Once the customer receives their disk the studio will no longer store their wedding files on the Studio’s computer systems. All files are now the customer’s responsibility.
A USB or Disk will be provided to you specifically for Facebook, Instagram and all other social media. This will be appropriate in size for loading and will contain the company logo. For the protection of both the individuals and the business all Facebook post should be done with these images. Once any files, disks, albums or prints leave the studio the customer deems the work acceptable
Customer gives their permission for the Studio to use any photograph/footage taken by the Studio in any manner, such as for the purposes of professional photo award competitions, advertising or promotion, albums etc
Where an engagement session is included, customer understands that these will be photographed midweek only, at a location selected by the photographer.
Video cover is that of the most natural the Studio can capture on your day. Raw/unedited footage is provided on DVD or USB. Length of footage can vary between 60mins to 3 hours (but not exclusively) Videos do not include editing to music/special effects as standard but can be quoted after the wedding.
If the Studio has incurred a car park/taxi expense the customer understands this expense will be payable by them.
Some parks, gardens and places require permits for weddings. It is the Customers responsibility to organize these permits and pay any necessary fees. The Studio is not liable for any fines or costs if this is not arranged.
The Studio takes the utmost care with respect to all aspects of your photography/Videography requirements. However, in the event that the Studio fails to comply with the terms of this agreement, due to negligence, accident, or any other avoidable or unavoidable action, the Studio and/or photographers/videographers liability is limited to a refund of monies that have been paid to the Studio.

By booking our services the Customer acknowledges they have read, understand and agree with the above conditions. The Customer will also receive their copy of these terms of trade, the booking form/schedule and wedding price list.

If there are any delays during the production we will inform the client of the new estimated delivery time

Costs of Recovery for All photography/video services

The debtor/s shall pay for all costs actually incurred by The Studio in the recovery of any monies owed under this Agreement including recovery agent costs, repossession costs, location search costs, process server costs and solicitor costs on a solicitor/client basis.
